[ §1 Object and start of contract]

The subject of the terms and conditions is the commercial practice of wellness massages. The contract begins with the binding agreement of the appointment.

[ §2 General information ]
​

My massages may only be carried out on healthy people for prevention and relaxation and are not a substitute for medical massages. In their own interest, clients are obliged to inform themselves in advance about possible contraindications   of existing health restrictions and to notify me. If in doubt, a doctor should be consulted as to whether he/she can recommend a massage at the current time. The applications are exclusively for well-being and relaxation. The massages do not replace a visit to the doctor or naturopath. No diagnoses are made or promises of healing are made. If your body is not used to massages (massages have an extremely positive, but also profound effect), it can in rare cases lead to undesirable reactions (e.g. hot flashes, sore muscles, headaches), which will subside quickly and will certainly not leave any permanent damage .

I point out that I do not offer any sexual acts. Sexual innuendos and assaults will result in the immediate end of the massage and will result in prosecution if my limits are not followed. The basis for practicing wellness massages in Germany is the EU regulation no. 96919020 (KNIF) of the VALO laws of January 17th, 2012.

[ §3 Contraindications ]
​

The massage takes place at the express request of the customer. BEFORE the first treatment, you will be made aware of the general terms and conditions and disclaimer and will therefore be given responsibility for yourself as to whether, to the best of your knowledge, you are free of illnesses and complaints that stand in the way of an application.

I would also like to inform you that a massage under the influence of alcohol or drugs or on a full stomach is not recommended.

  • Lymphangitis (blood poisoning – emergency!)

  • Mushrooms

  • warts

  • tumors

  • eczema

  • boil

  • infections

  • burns

  • Open wounds

[ Muscle diseases ] 

  • hamstring tear

  • ligament or tendon rupture

  • After fresh surgical interventions

  • Myositis, myositis ossificans, myastenia gravis

  • Melanomas (tumors) and liver spots (nevus) on the foot

  • After surgical procedures on the foot or lower leg

  • Burns, open wounds, warts, eczema, boils

  • Acute injuries (muscle fiber tear, ligament or tendon rupture)

  • Neurological diseases such as multiple sclerosis, epileptics, spasms

  • Pregnancy (not in the first 3 months and the last 6 weeks)

  • Acute and painful rheumatic diseases of the foot (M. Bechterew)

  • Diseases that require surgery (e.g. appendicitis, colic)

[ §4 treatment time ]

The prices refer to the entire treatment (preliminary talk, massage, rest period, follow-up talk = length of stay). Out of consideration for the following customers, please always appear to the point!

[ §5 Dates ]

Appointments are binding and can be arranged online, by telephone or email. Requested reductions in treatment time will be offset against the full treatment price. The customer is asked to meet the scheduled appointment for an application to ensure a smooth process. For customers who come late to an appointment, the actual massage time is reduced accordingly if there is an appointment afterwards. The customer has no claim for compensation for an agreed but unused service. A cancellation is therefore generally not possible (the full price will be charged), but a postponement of the appointment. This must usually be communicated up to 24 hours before the appointment. If the customer wants to postpone his appointment after this period of 24 hours or does not show up for the agreed appointment (regardless of whether he is excused or not), it is my goodwill to arrange an alternative appointment. Vouchers and free massages expire in absence.

[ §6 Prices and payment ]

Payment for your massage must always be made after the application. You can preferably pay by bank transfer, with a voucher or in cash in the customary currency (Euro). Of course, you will receive an invoice on request. Unfortunately, it is not possible to bill your statutory health insurance company or private health insurance company. Gift vouchers are sold in cash or in advance.

[ §7 cancellation modalities ]

In principle, the customer can reschedule his appointment free of charge up to 24 hours before the appointment at the latest. This must always be done by phone! If the customer does not show up for the agreed appointment within this period (regardless of whether they are excused or not), the full costs of the application will be charged and it is my goodwill to arrange an alternative appointment. Vouchers and free massages also expire if you are absent. If the customer insists on "sexual" massages or requests treatments that I cannot or may not treat due to my training, an acute health risk to the customer or for legal reasons, I will withdraw from the treatment. The customer also has the right to withdraw if the relationship of trust is so disturbed that it would not make sense for the customer to continue using the application. In all these cases, my claim to fees for the services provided up to the time of withdrawal remains intact.

[ §8 Disclaimer ]

The treatment and use of the infrastructure (equipment, facilities, aids, premises) necessary for treatment or participation in training is entirely at your own risk. No liability is assumed for damage to health and property. I would also like to point out that my offers are not a substitute for medical or psychotherapeutic treatment or care. I neither make medical diagnoses nor do I carry out medical therapy or psychotherapy.

[ §9 data protection ]

I assure you that I will not pass on any of my customers' data to third parties. Of course, I give my customers information about their stored data at any time and will delete them immediately, meticulously and permanently if they wish.

[ §10 Final Provisions ]

If I am "permanently" no longer able to make appointments or to meet appointments (e.g. for health reasons), the treatments already paid for will be refunded. This applies specifically to gift vouchers. Free massages expire without replacement.

If a provision of these terms and conditions is ineffective, the remaining provisions remain unaffected.
